This Acceptable Use Policy ("AUP") applies to everyone who accesses or uses Incenti EDOS, Incenti Insights, or any other product or service of Incenti Solutions, Inc. ("Incenti") — including Authorized Users under a customer's account, administrators, and third parties who submit information through forms hosted on the platforms.
This AUP is incorporated into the Master Subscription Agreement (the "MSA"). If this AUP conflicts with MSA § 6, the MSA controls. Capitalized terms have the meanings given in the MSA. Where you use the platforms under an organization's account, that organization is responsible for your compliance.
1. Accounts and credentials
- Credentials belong to one named individual. Do not share them — simultaneously, rotationally, or through a generic or shared mailbox address.
- Keep credentials confidential, use multi-factor authentication where available, and tell us promptly at security@incenti.co if you believe an account has been accessed without authorization.
- Consultants and contractors may use a customer's account only for that customer's benefit — never to serve their other clients through it.
2. Content you may not submit
Do not upload, submit, or transmit:
- content you do not have the right to submit, or that infringes anyone's intellectual property, privacy or other rights;
- malicious code of any kind;
- content that is unlawful, defamatory, harassing or deceptive;
- any biometric identifier — face geometry, fingerprint, voiceprint, retina or iris data, or any measurement or embedding derived from one;
- Restricted Data (see § 6 below) without a signed written addendum permitting it.
You are responsible for what you submit. Incenti does not pre-screen customer content and has no obligation to do so.
3. Platform integrity
Do not:
- probe, scan, or test the security or vulnerability of the platforms, or attempt to breach any access control, without Incenti's prior written consent (MSA § 9.6 explains how to request a test);
- interfere with the operation of the platforms or with any other customer's use of them;
- use robots, spiders, scrapers, headless browsers or other automated means to access the platforms or to circumvent any rate, access or export limit — the published APIs, used within their documented limits, are the only permitted automated access;
- access another customer's account or data, or attempt to;
- benchmark the platforms or publish performance information about them.
4. Data use
Do not:
- use the platforms, Incenti Data or AI Output to build, train, benchmark or improve a competing product or service;
- reverse engineer, decompile, or attempt to derive source code, model weights, algorithms, multipliers or coefficients;
- re-identify or attempt to re-identify anyone or anything from de-identified, aggregated or statistical data — including benchmarks, indices, peer comparisons and suppressed or summarized values — or combine such data with other data to identify any person, company, project, property, prospect, applicant, award recipient or Incenti customer;
- bulk-extract or systematically accumulate Incenti Data, benchmark values, multipliers or model outputs — by prompt, automation, or repeated manual export;
- remove or alter attribution, copyright notices, watermarks or required disclaimers;
- resell, sublicense, or redistribute Incenti Data except as your agreement expressly permits;
- use anything in the platforms in a way that would subject Incenti software or data to open-source or open-database license terms.
5. AI features
The AI features assist human decision-makers; they do not replace them. Do not use AI features or AI output:
- as the sole basis for deciding incentive eligibility, award amounts, disqualification, or site shortlisting — a qualified person must make the final decision, considering more than the AI output (MSA § 12.6(c));
- to make or materially inform a decision about a person based on, or as a proxy for, any legally protected characteristic;
- to make or materially inform decisions about a person's employment, credit, insurance, housing, education, or access to essential public services;
- for social scoring;
- to determine any person's creditworthiness or financial status — Incenti is not a consumer reporting agency and nothing on the platforms is a consumer report (MSA § 12.11);
- to train, fine-tune or develop any AI or machine-learning model (labeled in-product feedback under MSA § 12.2(c) is the only exception);
- to generate unlawful, infringing, harassing or deceptive content, or to impersonate anyone;
- in violation of the usage policies of the AI model providers identified on our Subprocessor List.
6. Restricted Data
The platforms are not designed or authorized to hold the following, and you may not submit them without a signed addendum: criminal justice information (CJIS/CHRI); federal tax information (IRS Pub. 1075); protected health information (HIPAA); education records (FERPA); CUI, classified, or export-controlled (ITAR/EAR) information; payment card data outside a designated PCI-scoped integration; Social Security or other government ID numbers, financial account numbers, precise geolocation of individuals, or data of children under 13, except as the Documentation and DPA expressly contemplate; and personal data of individuals in the EEA, UK or Switzerland except under the DPA. The EEA, UK and Switzerland restriction does not apply to business contact information and submissions received from individuals and organizations outside the United States in the ordinary course of your organization's outreach, including responses to RFIs, RFPs and inquiries.
If you discover Restricted Data has been submitted, notify us promptly at privacy@incenti.co and we will work with your organization to remove or quarantine it.
7. Lawful use
Use the platforms only in compliance with applicable law — including export control and sanctions, employment, fair housing, fair lending, civil rights, public records and procurement law — and never in any application where failure could lead to death, personal injury, or physical or environmental damage.
8. Enforcement
Violations of this AUP may result in suspension of access under MSA § 18, termination under MSA § 19.2 (a ten-day cure period applies to the violations MSA § 6.3 designates material), and removal of content. We will apply the narrowest remedy reasonably available and, where practicable, notify the account administrator first. Nothing in this AUP limits Incenti's other rights or remedies.
9. Reporting
Report suspected violations, vulnerabilities or abuse to security@incenti.co. Report claimed copyright infringement under our DMCA Policy at https://incenti.co/legal/dmca.
10. Changes
We may update this AUP as the platforms and the law evolve. Material changes take effect for existing customers as MSA § 26 provides. Prior versions are archived at https://incenti.co/legal.
